Like Game Boy (GBC and SGB) and DS (DSi), "enhancement" information should be recorded for 3DS - i.e. if a game is New 3DS Enhanced. It seems like the best (and probably foolproof way) to determine this would be by checking which services the ROM has access too. You can do this with ctrtool or rom-properties. I do actually have set of metadata collected (ie.g. ctrtool printouts) from a 3DS fullset (albeit an outdated one), so I could do this in the future reasonably easily.

I say its foolproof, because without those services enabled, the game shouldn't actually be able to access the New 3DS hardware. But I guess the "New3DS Sys Mode" field in the exheader should also be checked, as should the cart type flag in the Cart ID. Also I guess it may be possible for a game to have New 3DS stuff enabled, but not actually used.
